Possession of "Controlled Dangerous Substance" (CDS) with Intent to Distribute

NJSA 2C:35-5, makes it illegal to possess or manufacture a CDS with intent to distribute (sell) it. The quantity and type of the drugs or ingredients controls the grading of the crime. Oftentimes, the State will charge a defendant with this crime when they are found in possession of larger quantities of drugs, especially when they are packaged in a way that would not indicate individual consumption. For example, if a defendant was found with a large quantity of cocaine packaged in numerous small baggies rather than in one large one.
